2. Our Products
We make reasonable efforts to display product information accurately. However, colors and appearance may vary due to device screens and settings.
Unless expressly stated otherwise, we do not guarantee that the appearance, color, or finish of products will match how they appear on your screen.
Product descriptions, pricing, and availability may change at any time without notice. We reserve the right to discontinue products or limit quantities by person, household, geographic region, or jurisdiction at our discretion.
Certain items are made to order and produced specifically after your purchase. Production and shipping timelines are estimates and may vary based on materials availability, quality control, and carrier delays.
Made-to-order items are eligible for our free 30-day return policy, unless otherwise stated at the time of purchase.
3. Orders
When you place an order, you are making an offer to purchase. We may accept or decline any order in our discretion. An order is not accepted until we confirm acceptance and successfully process payment.
We reserve the right to refuse or cancel any order suspected of fraud, unauthorized activity, or violation of these Terms.
Please review your order carefully before submitting. Once an order is accepted, we may be unable to accommodate changes or cancellations.
If we cancel or modify an order, we will attempt to notify you using the contact information provided at checkout.
Purchases are subject to returns or exchanges only in accordance with our Refund Policy.
You represent and warrant that purchases are for personal or household use only and not for commercial resale or export.
Because made-to-order items enter production shortly after an order is placed, we may not be able to modify or cancel an order once production has begun. Requests for changes should be submitted as soon as possible, and we cannot guarantee modifications after acceptance.
Custom, personalized, or special-order items are created specifically to your specifications and are final sale and not eligible for return or exchange, except in the case of manufacturing defects or errors on our part.
4. Prices and Billing
Prices, promotions, and discounts may change without notice. The price charged is the price shown at the time you place your order, as reflected in your order confirmation.
Unless stated otherwise, prices do not include taxes, shipping, handling, customs duties, or import fees, which may apply depending on destination and carrier requirements.
You agree to provide accurate, complete purchase and account information and to promptly update it as needed so we can process transactions and contact you.
You represent and warrant that you are authorized to use the payment method provided and that all charges incurred will be honored by your payment provider.
5. Shipping and Delivery
Delivery dates are estimates and not guaranteed. We are not liable for delays caused by carriers, customs, or events outside our control.
Unless required otherwise by applicable law, title and risk of loss pass to you once the package is transferred to the carrier.
For made-to-order pieces, delivery estimates include production time plus shipping time. All timelines are estimates and not guaranteed.
Once an order is marked as delivered by the carrier, responsibility for the shipment transfers to the customer, except where prohibited by applicable law.
6. Intellectual Property
All content included in the Services—such as trademarks, logos, product names, text, images, graphics, video, audio, and the design and arrangement thereof—is owned by LushStonez or its licensors and protected by applicable intellectual property laws.
You may use the Services for personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any part of the Services without our prior written permission, except as expressly permitted by law.
LushStonez names, logos, product names, designs, and slogans are trademarks of LushStonez. Shopify’s name and marks are trademarks of Shopify. All other marks belong to their respective owners.
7. Optional Tools
We may provide access to third-party tools as part of the Services. These tools are provided “as is” and “as available,” and we do not control or endorse them. Your use of optional tools is at your own risk and subject to the third party’s terms.
8. Third-Party Links
The Services may contain links to third-party sites or embedded functionality. We are not responsible for third-party content, practices, or transactions. If you leave our Services, you do so at your own risk and should review the third party’s policies.
9. Relationship With Shopify
LushStonez is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with LushStonez. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and LushStonez, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with LushStonez.
10. Privacy
Our collection and use of personal information is governed by our Privacy Policy. Shopify may also collect and process information as described in Shopify’s privacy policy. By using the Services, you acknowledge that you have read and understand these policies.
11. Feedback and Reviews
If you submit reviews, suggestions, ideas, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display such Feedback for any lawful purpose, including marketing and improving the Services.
You represent and warrant that you own or have the necessary rights to submit Feedback and that it does not violate any third-party rights or applicable law.
We may remove Feedback at our discretion if we believe it is unlawful, abusive, obscene, misleading, or otherwise objectionable.

We may occasionally publish information containing typographical errors, inaccuracies, or omissions related to product descriptions, pricing, promotions, shipping charges, transit times, or availability. The Services and all products offered through the Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement, except where such warranties cannot be excluded under applicable law.
We do not guarantee that the Services will be uninterrupted, timely, secure, or error-free.
Some jurisdictions do not allow limitations on implied warranties, so some of the above may not apply to you.
16. Limitation of Liability
To the fullest extent permitted by law, LushStonez (and its affiliates, partners, officers, directors, employees, agents, contractors, service providers, licensors, and those of Shopify and its affiliates) will not be liable for any indirect, incidental, punitive, special, or consequential damages, including lost profits, lost revenue, loss of data, or replacement costs arising from your use of the Services or any products purchased through the Services.
In jurisdictions that do not allow certain limitations of liability, our liability will be limited to the maximum extent permitted by law.
17. Indemnification
You agree to indemnify, defend, and hold harmless LushStonez, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, your violation of any law, or your use of the Services.
18. Severability
If any provision of these Terms is held unlawful or unenforceable, the remaining provisions will remain in full force and effect.
19. Waiver; Entire Agreement
Failure to enforce a provision of these Terms is not a waiver. These Terms and all policies referenced here constitute the entire agreement between you and us regarding the Services and supersede prior agreements or communications.

You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms without notice.
21. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. You consent to exclusive jurisdiction and venue in the state and federal courts located in Los Angeles County, California.

Headings are for convenience only and do not affect interpretation.
